GENERAL SALES CONDITIONS

These General Sales Conditions regulate the sales relations between the Individual Company EURASIA by Cervelli Tiziana with registered office sited at n. 12, Via Volterrana, Colle di Val d’Elsa (SI), Zip Code 53034 Italy and the Operational Office situated at n. 21, Via Giuseppe Mazzini, Colle di Val d’Elsa (SI), 53034 Italy, VAT number 00314170523, pec: eurasia1981@sicurezzapostale.it hereinafter referred to as EURASIA or  SELLER and all the people hereinafter referred to as CUSTOMER or USER who visit or make a reservation through the web SITE www.eurasia1981.com hereinafter referred to as the SITE.

The offer and sale of products on the SITE are therefore ruled exclusively by these General Sales Conditions, formulated in accordance with the current legislation on contracts concluded outside of business premises. These conditions, also in consideration of regulatory changes, may be modified. It is understood that the applicable conditions will be those in force on the SITE when booking.

These conditions rule purchases made on the SITE, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by the Legislative Decree. n. 21/2014 and by the Legislative Decree 70/2003 on electronic commerce.

The access and use of this SITE presuppose the reading, knowledge and acceptance of these General Sales Conditions.

The sale and /or distribution of products purchased on the SITE is strictly prohibited and will be prosecuted as disposed by the law.

 

1. THE COMMERCIAL POLICY OF EURASIA 1981

With these General Sales Conditions, EURASIA sells and the CUSTOMER remotely purchases, the tangible movable goods indicated and offered for sale on the SITE. The contract is concluded exclusively through internet, by the CUSTOMER accessing at the SITE address www.eurasia1981.com and the creation of a purchase order according to the procedure provided in the SITE itself.

The CUSTOMER undertakes to read these General Sales Conditions, in particular the pre-contractual information provided by EURASIA, before proceeding with the confirmation of the order.

In the order confirmation e-mail, the CUSTOMER will also receive the link to download and archive a copy of these General Conditions of Sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

 

 2. PURCHASES ON THE SITE

EURASIA carries out its e-commerce activity through the SITE and all purchases are aimed exclusively at final users who play the role of “consumers”, where consumers must be understood as natural people acting for purposes not related to their commercial, entrepreneurial or professional activity.

The USER is allowed to purchase multiple products with the same order.

EURASIA reserves the right to refuse or cancel orders in the following cases:

– a USER with whom it has a legal dispute in progress;

– a USER who has previously violated the conditions and / or terms of the purchase contract;

– a USER who has been involved in fraud of any kind and, in particular, in fraud relating to payments by credit card;

– a USER who has released false, incomplete or otherwise inaccurate identification data.

EURASIA reserves the right in any case to evaluate the acceptance of the received orders.

EURASIA will notify the CUSTOMER via e-mail of any inability to accept the received orders.

 

2.1 METHOD OF PURCHASE

The purchase of products on the SITE takes place exclusively in “guest” mode (without registration), the data required in order to complete the order will be stored in the SITE database only for the period of time necessary to process the order itself and the USER will be required to enter the same data for each new order.

The purchase contract for one or more products on the SITE will be concluded between the CUSTOMER and EURASIA when the SELLER receives the order form electronically, after verifying the correctness of the data relating to it.

In order to complete the purchase, the USER, in the “cart” section, must also enter the shipping address and the data required for payment.

The chosen products and the entered data can be modified until the final order is placed, which must be done by selecting the “Proceed with the order” button.

Orders, once transmitted to the system, can no longer be modified or blocked; it is, therefore, CUSTOMER’s responsibility to ensure that they are correct before confirming them. For orders placed through the SITE, an email confirming the order just placed will be sent to the CUSTOMER’s e-mail box at the time of receipt. Purchasing through the SITE constitutes acceptance of these General Sales Conditions.

 

2.2 ORDER

In order to proceed with the purchase of the products, the USER must send the purchase order and complete the payment, following the procedures indicated in the specifically dedicated sections. For each chosen product, a descriptive card is displayed with the aim of illustrating the goods themselves, containing the price, image and essential characteristics.

The USER can select one or more products he intends to purchase by placing them in a virtual “cart”. The contents of the “cart” can always be viewed by the USER before proceeding with the order. By accessing the “cart”, the USER will be able to know, before purchasing and paying, any information relating to the purchase of products, including shipping costs.

EURASIA undertakes to describe and present the items sold on the SITE in the best possible way. Nevertheless, the images and colors of the products offered for sale on www.eurasia1981.com may not correspond to the actual ones due to the Internet browser and / or used monitor. EURASIA declines all responsibility for any inaccuracies due to a particular configuration of the computer or its malfunction.

The pictures of the products presented on www.eurasia1981.com do not constitute a contractual element, since they have to be considered exclusively as representative.

At the time of sending the order form, the CUSTOMER will be warned that such sending involves the obligation to pay the indicated price. Before proceeding with the transmission of the order form, the CUSTOMER will also be requested to identify and correct any data entry errors.

With the electronic transmission of the order form, the CUSTOMER confirms that he is aware of and accepts the General Conditions of Sale and the additional information contained on the SITE www.eurasia1981.com, including the Privacy Policy and the information on the right of withdrawal, and accepts unconditionally and undertakes to observe these General Conditions of Sale in relations with the SELLER.

Once the contract is concluded, EURASIA will send the CUSTOMER, by e-mail, a confirmation of the purchase order, containing the link with the General Sales Conditions and the summary document on the right of withdrawal and, therefore, all the information already contained in the summary of the commercial and contractual conditions displayed before proceeding with the purchase.

The CUSTOMER also declares to acknowledge that the product he purchases is intended exclusively for the country in which the order is placed; therefore, if you decide to place the product in a different country, you are responsible for placing it and must follow the applicable regulations and restrictions both for exporting from the country where you purchased the item and for importing into the country where the product is placed.

 

2.3 AVAILABILITY OF THE PRODUCTS

The products offered for sale and the relative price are those indicated on the SITE. The availability of the products must however be considered purely indicative as:

– the products could be sold to other users before order confirmation, due to the simultaneous presence on the SITE of multiple users;

– an IT anomaly may occur such as to make a product available for purchase that is not actually.

If the products are not available at the time of the order, the corresponding size is not displayed. In this regard, however, it should be noted that out of stock / sold out products may remain on the SITE for a period of seven days from their exhaustion.

If, due to the simultaneous purchase by several Customers, the product /s ordered / are no longer available, the CUSTOMER will be immediately informed by e-mail of the cancellation of the order.

The CUSTOMER will also be informed of the methods and timing of reimbursement of any sums paid. This even in the case of a multiple order if all the products subject to the multiple order are unavailable or only some of them, and in this case the refund will only concern the unavailable products. The resolution of the entire multiple order will be possible only in case of evident and proven accessory nature of the product (s) object of the multiple order which has become unavailable compared to the other products object of the multiple order available.

EURASIA may change the products offered for sale on the SITE and the relative price at any time and without notice.

 

3. PRICES

The price of each item is expressed in EUROS. For shipping costs, please refer to Point 5.1 below. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the SITE or these Conditions. Any customs duties are not included in the purchase price and will be charged to the CUSTOMER.

EURASIA reserves the right to change the price of the products at any time, without notice, it being understood that the price charged to the USER will be the one indicated on the SITE at the time the order is placed and that any changes will not be taken into account ( increasing or decreasing) subsequent to the transmission of the same. Product prices may be subject to updates. The CUSTOMER undertakes to view the final sale price before proceeding to forward the relevant order form.

In case of an IT, manual, technical, or any other type of error that could lead to a substantial change, not foreseen by EURASIA or otherwise visible on the SITE, of the retail price that makes it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled and the amount paid by the CUSTOMER will be refunded.

 

4. METHOD OF PAYMENT

Payment for products purchased on the SITE can be made:

– by CREDIT CARD: at the time of purchase, customers enter their credit card details in a secure electronic banking system provided by Stripe, Inc., Stripe Payments Company, San Francisco CA, United States platform. Financial information will be forwarded, via encrypted protocol, to the STRIPE platform which provides the related remote electronic payment services, without third parties having access to it in any way. Furthermore, this information will be never used by the SELLER except to complete the procedures relating to the purchase and for  issue related to refunds in case of any product returns, following the exercise of the right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on www.eurasia1981.com. The price for the purchase of the products, shipping and delivery costs, as indicated in the order form, will be charged to the CUSTOMER at the time of shipment of the purchased products.

Purchases can be made by Visa, Mastercard, American Express. For more information, please visit www.visa.com, www.mastercard.com or www.americanexpress.com.

In order to guarantee the best protection for purchases made in the e-commerce sector, EURASIA recommends its customers to join the services offered by their banking system by requesting a PIN security code with which will allow them to carry on their purchases in safety.

If the existing funds are sufficient for the purchase and the bank details provided are valid, the transaction will be processed instantly. The purchase amount will be fully charged at the time of purchase. In case the successful payment is not confirmed, the contract will be considered terminated pursuant to the law and for the purposes of art. 1456 of the Italian Civil Code; the termination of the contract, of which the USER will be notified by e-mail, as result of the order cancellation.

– by BANK TRANSFER: during the payment step, in “payment method”, choose the “bank transfer” option and complete the order. Please transfer the total amount within 48 hours from the time of purchase indicating the order number: any bank and bank transfer charges will be charged to the CUSTOMER. The order will be shipped when the transfer is actually credited to the bank account and as soon as the goods are available in the SELLER’s warehouse.

The amount of returns will be refunded with payment to the bank account with which the payment of the order was made. Once this term has expired, the contract will be considered terminated pursuant to the law and for the purposes of art. 1456 of the Civil Code. The termination of the contract, of which the USER will be notified by e-mail, will determine the cancellation of the order and the refund of the due amount in case of any subsequent credit. This payment method is not active for all destinations, so please check the availability in the cart at the time of purchase.

– by PAYPAL: in this case the CUSTOMER can pay directly through his Paypal account. EURASIA reserves the right to ship the goods only to the address indicated on the account verified by Paypal.

– by CASH ON DELIVERY: by choosing this method, the CUSTOMER can pay directly to the courier upon delivery. The latter only accepts exact amounts in banknotes or coins and does not provide the return of the change. Cash on delivery is only possible in Italy and with amounts not exceeding € 1,999.00

EURASIA reserves the right to ship the order only to the billing address.

 

5. METHOD OF SHIPPING

EURASIA will ship the products only after verifying the actual crediting of the payment due by the CUSTOMER. The risk of loss or damage of the products for reasons not attributable to EURASIA will be transferred to the CUSTOMER when the latter, or a third party designated by him and other than the carrier, materially comes into possession of the products.

Information on shipping methods and costs are indicated at the time of purchase, before making the payment. For shipping costs, please refer to Point 5.1 below and are charged to your credit / debit card at the time of purchase. All purchases with an address in Italy are delivered by DHL courier.

We do not ship with post office boxes.

 

5.1 SHIPPING COSTS

Shipping costs and delivery times depend on the country of destination, so please refer to the information below and point 5.2.

Customers are informed that any customs duties and import taxes are charged to the CUSTOMER for any destination. The relative amount has to be paid to the courier as indicated by the courier himself. During the sales period for all orders, the transport costs will be borne by the CUSTOMER. All orders are delivered by DHL from 9 a .m to 5 p. m, from Monday to Friday. The shipper requires the recipient’s signature “for receipt” at the time of delivery. Orders placed from Friday to Sunday will be processed the following Monday. Once the items have been shipped, it is no longer possible to change the destination address.

 

5.2 DELIVERY TIME

EURASIA declines all responsibility for any delays in shipments caused by weather conditions, customs controls or other circumstances beyond its direct control.

The estimated time for delivery of shipments destined in Italy is expected within 1-2 working days.

The estimated time for delivery of shipments in the European Union is expected within 2-3 working days. The estimated time for the delivery of shipments in all other countries outside the European Union is expected to be within 4-8 working days depending on the different destinations.

Attention: in Italy the following dates are holiday days and no shipments are made: 1st January, 6th January, Easter and Easter Monday, 25th April, 1st May, 2nd June, 15th August, 1st November, 8th December, 25th December and 26th December .

The CUSTOMER is requested to provide a valid address to which the goods can be delivered during delivery times. Please promptly indicate any change of address.

EURASIA at the time of shipment informs the CUSTOMER by e-mail of the DHL shipment number.

Any delivery delays exceeding 10 (ten) days. work must be promptly reported to our Customer Service in accordance with the procedures set out in the following art. 12.

 

5.3 RECEIPT AND ACCEPTANCE OF GOODS

The delivery obligation is fulfilled by transferring the material availability or in any case the control of the products to the USER. To ensure the safety of the shipment, the shipper asks for the signature “for receipt” of the recipient at the time of delivery; if this is not possible, the goods will be not delivered.

The USER acknowledges that the withdrawal of the product is a specific obligation arising from the purchase contract. It is up to the USER to check the conditions of the product that was delivered to him. Without prejudice to the fact that the risk of loss or damage to the products, for reasons not attributable to EURASIA, is transferred to the USER when the USER, or a third party designated by the same and different from the carrier, materially comes into possession of the products, if, at the moment of the delivery, the external appearance of the package presents imperfections, the CUSTOMER must proceed with the opening of the package at the presence of the carrier.

We recommend checking the goods upon delivery and verifying that the quantity of delivered products corresponds to what was ordered, that the packaging is intact, undamaged, or otherwise altered. In case it is found that the goods are damaged or do not comply with the ordered quantities , the CUSTOMER must immediately report it to the carrier and sign the delivery document with reserve as well as inform EURASIA at the e-mail address: customercare@eurasia1981.com.

Any problems in delivery must be promptly reported to our Customer Service in accordance with the procedures set out in the following art. 12.

 

5.4 TRACEABILITY OF THE SHIPMENT

When the order is entrusted to the courier, EURASIA notifies the CUSTOMER by e-mail of the DHL shipment number.

To monitor the progress of the shipment, customers can visit the website http://www.dhl.com and enter the awb number indicated in the e-mail in the appropriate “search” area.

 

5.5 FAILED DELIVERY

All customers, by placing an order, establish a commercial relationship with EURASIA and undertake to accept delivery of the package relating to their order. If a package is not delivered to the CUSTOMER’s address for reasons attributable to its lack of cooperation (incorrect / incomplete telephone number, incorrect / incomplete address, absent recipient) or if the CUSTOMER refuses the delivery, the package is returned to the sender EURASIA in Italy at customer’s charge. The costs to be paid by the CUSTOMER include shipping costs and any customs duties; these expenses will be deducted from the due refund .

 

6. RETURNS AND CHANGES

If the USER, after the purchase of a product and its receipt, for any reason is not satisfied with his purchase, the unworn items can be returned for size / color change with refund within 14 days from the date of receipt of the goods. The exchange and / or return of the product will be possible, provided that the garments have not been worn, washed or altered and do not show any signs of use, under the following conditions:

– exchange for a different size or a different color of the same item, if available;

– the soles of the shoes are in perfect condition and show no signs of any kind;

– all footwear and accessories must be returned with the security seal intact together with their original box, which is considered to all intents and purposes an integral part of the product itself and which must not have been in any way damaged and / or altered, or used as the only outer packaging.

Each garment must be returned with all labels and tags attached, and inclusive of all original packaging and accessories (dustbags, hangers, clothes covers, etc.) received with the order.

Returns must be shipped inside the same receiving packaging provided by EURASIA, which must be well sealed with adhesive tape; failing that, another packaging suitable for the shipment of the items can be used.

 

6.1 PROCEDURE AND INSTRUCTIONS FOR RETURNS

Returns made after the indicated deadline may be accepted only at the discretion of EURASIA.

The refund, excluding shipping costs, is credited to the same credit and debit card used for the purchase or to the current account used for the bank transfer.

In case you want to request a return authorization, please contact EURASIA Customer Service at: customercare@eurasia1981.com, specifying the order number and the items to be replaced. Once the procedure is completed, the USER will receive a confirmation by e-mail, containing the Return Authorization Number (R.A.N.), the shipping label and the instructions to be followed to return the goods. It is recommended to wait for the return authorization sent by email from www.eurasia1981.com; this communication must be compulsorily inserted inside the package.

The return is accepted only if the procedure indicated in this paragraph has been followed. Unauthorized returns are not accepted: therefore, if the CUSTOMER still sends the return package, he will not receive any refund. The refund will be made as soon as the return arrives at the EURASIA warehouse and if the items are intact. For orders paid by credit card, the refunded amount will be available to customers in about ten (10) days, and will still be visible on the next credit card statement; the timing may vary according to the banking circuit of the credit card used. For orders paid with Paypal or bank transfer, the amount will be returned to the original account. The refund will be issued in the same currency as the original purchase. Any differences in amount due to exchange rate fluctuations cannot be refunded.

 

6.2 RETURN F GIFTS

In case of products purchased and sent as gifts, the return can be exercised exclusively by the CUSTOMER and in no case by the recipient of the gift, following the procedure described above. It is understood that the integrity of the product is an essential condition for returning the product.

 

6.3 PROCEDURE AND INSTRUCTIONS FOR THE EXCHANGE

The exchange operation can only be carried out for a different size or a different color of the same item, if available. Exchanges requested after the deadline indicated above can only be accepted at the discretion of EURASIA. Unauthorized changes are not accepted.

For the return of the product for the purpose of exchange, please refer to the procedure indicated above for “Return”. The USER is invited to indicate the new size / measurement, respecting the conditions set out in the return procedure, described in the appropriate section above. If you wish to exchange the product for another item, we recommend that you request a refund and make a new purchase separately.

In case of an exchange, the return of the product involves the payment of the return costs borne by the CUSTOMER (In case of an error by www.eurasia1981.com, the shipment will have no additional costs). The replacement product will be sent to the CUSTOMER by courier.

 

 7. RIGHT OF WITHDRAWAL

The USER who acts as a consumer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products. In case of multiple purchases made by the CUSTOMER with a single order and delivered separately, the 14-day term starts from the date of receipt of the last product. The CUSTOMER who intends to exercise the right of withdrawal must notify EURASIA by means of an explicit declaration of wanting to withdraw from the contract, which can be sent by registered letter with return receipt. or to the following e-mail addresses:

As an alternative to the above declaration, the CUSTOMER can send the standard withdrawal form, as per Annex I, Part B, Legislative Decree 21/2014, the use of which is not mandatory, as follows:

In case of exercise of the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which he communicated to EURASIA his will to withdraw from the contract.

The goods must be returned to EURASIA, Via Giuseppe Mazzini No. 21 – 53034 Colle di Val d’Elsa Siena Italy.

The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, EURASIA will refund the amount of the products subject to withdrawal within a maximum period of 14 days.

The return shipment is charged to the CUSTOMER, according to the following rates:

Italy: Euros 10.00 (ten / 00);

Europe: Euros 20.00 (twenty / 00);

Rest of the world: Euros 30.00 (thirty / 00).

Any customs duties that will be deducted from the refund are charged to the CUSTOMER.

As required by Art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, EURASIA may suspend the reimbursement until receipt of the goods or until the CUSTOMER demonstrates that he has returned the goods to EURASIA.

EURASIA will reimburse using the same payment method chosen by the CUSTOMER at the time of purchase. In the case of payment made by bank transfer, and if the CUSTOMER intends to exercise his right of withdrawal, he must provide EURASIA with the IBAN, SWIFT and BIC necessary for the refund by EURASIA.

In case of withdrawal for a purchase made with a gift card, the amount will be returned to the CUSTOMER.

 

8. LEGAL GUARANTEE OF CONFORMITY

All products sold on the SITE are covered by the Legal Guarantee of Conformity provided for by articles 128-135 of the Legislative Decree n. 206/2005 (“Consumer Code”). The Legal Guarantee is reserved for consumers. Therefore, it applies only to users who have made a purchase on the SITE for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. In case of receipt of defective products or in any case non-compliant with the orders placed, the CUSTOMER has the right to restore the conformity of the product without charge by repair or replacement. The CUSTOMER can exercise this right if the defect occurs within two years of delivery of the goods and reports the defect to EURASIA within two months of its discovery.

In case of lack of conformity duly reported within the terms, the USER has the right:

– primarily, to the free repair or replacement of the goods, at his choice, unless the requested remedy is objectively impossible or excessively expensive compared to the other;

– secondarily (in case  the repair or replacement is impossible or excessively expensive or the repair or replacement has not been carried out within reasonable terms or the repair or replacement previously carried out has caused significant inconvenience to the consumer) to the reduction of the price or termination of the contract, at your choice. The re-credit, including shipping costs in case of a defective product at the origin, is made on the same credit and debit card used by the CUSTOMER for payment. The replacement product will be sent to the CUSTOMER by courier without further shipping costs. In case a purchased product on www.eurasia1981.com, during the period of validity of the Legal Guarantee, manifests what could be a lack of conformity, the USER may contact the Customer Service, at the addresses indicated in art. 11. Customer Service will promptly reply to the communication, indicating to the USER what next steps he must take. The Product with respect to which the USER complains about the lack of conformity must be sent to EURASIA, which will verify the existence or otherwise of the claimed defect, to the following address: EURASIA, Via Giuseppe Mazzini n ° 21 – 53034 Colle di Val d ‘ Elsa Siena Italy. EURASIA, in the event of a defective or non-compliant product, will arrange, at its own expense, to organize the collection of the product, compatibly with the CUSTOMER’s availability. EURASIA reserves the right to ask the USER to attach the purchase invoice and / or DDT or other document proving the date to their request.

 

 9. LIMITATION OF LIABILITY

EURASIA has no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of  internet, in case it fails to execute the order within the time stipulated in the contract. Although EURASIA has taken all possible precautions to ensure the security of personal data, it must be borne in mind that the transmission of data over the internet is never completely secure and that any information disseminated online, including those for the purpose of payment for the purchase of the product, could be collected and used by subjects other than those to whom it was directed. EURASIA, therefore, declines all responsibility for any collection and / or use, even fraudulent, that may be carried out by third parties, of the  customers data and / or users on the SITE www.eurasia1981.com.

 

10. APPLICABLE LAW AND JURISDICTION

These General Sales Conditions are subject to Italian law. For any dispute relating to the application, execution and interpretation of these General Sales Conditions , the court of the place where the USER resides or has elected domicile, if located in the Italian territory, is competent.
